BANKING SECTOR REJECTS THEIR HARMONISED REGULATOR
You may have heard that similar harmonised regulators are under
consideration in several other areas of NZ law prompting the concern
that we will end up a state of Australia in all but name. Well,
the massively powerful banking sector has recently won its own battle
to defeat the trans tasman regulator they were being threatened with. Like
us, the banking sector knew that a harmonised sector under Australian
control would hurt the NZ sector.
Of course having lost their fight the Government quickly turned
about face and announced that they had decided not to do this because
they recognised such a regulator presented serious sovereignty issues
for NZ. HELLO! That is what we have been telling
them for the last 4 years and is equally true for natural health products
and medical devices. How come then the Government, so concerned
to protect NZ sovereignty is pushing ahead with the TTTGA which would
do just as much damage to our national identity? We suspect its
because they hope once they have one such body that will make it easier
to get through other such bodies in other areas. The Health of
New Zealanders cannot be sacrificed for such blatant political aims.
AUSTRALIA IS USING NZ TO SORT OUT ITS OWN PROBLEMS
We have always known the TGA was relying on NZ coming on board to
help it get even more powerful on a domestic basis and now we have

Look particularly at section 2 and 2.1 where the report details
how the TGA is limited in what it can do currently because of the Australian
constitution but how all those problems would be removed under the
TTTGA proposal as that would take them under the international treaty
provisions, exempting them from these limits.
So now it is clear, they are using NZ to get around the problems
they face at home and in our view this is only the tip of the iceberg. What's
more this makes it clear that the TTTGA would be elevated above the
normal protections of each country meaning there are serious questions
about the Treaty of Waitangi, NZ Bill of Rights, Official Information
Act etc as they apply to this agency.
